These Terms of Service ("Terms") govern your use of the IP Watch Nepal website and services. By using our site or engaging our services, you agree to these Terms. If you do not agree, please do not use the site or our services.

1. Who we are

IP Watch Nepal is an independent trademark-monitoring and IP support service based in Kathmandu, Nepal. We are not affiliated with, endorsed by, or connected to the Department of Industry, the Government of Nepal, or WIPO.

2. Services

We provide trademark monitoring, conflict screening, renewal tracking, filing support and related intellectual property services for Nepal's trademark system. Free tools on this site are provided as-is, for general informational purposes, and may be updated or withdrawn at any time without notice.

3. Monitoring scope

When you engage our monitoring service, we screen newly published trademark applications in Nepal's Industrial Property Bulletin against the marks, classes and search criteria you have provided. Our monitoring is based on the information you give us — we are not responsible for conflicts arising from criteria you did not disclose.

Alerts are provided to inform your decision-making. They do not constitute legal advice. You remain solely responsible for deciding whether and when to take action, and for engaging a qualified IP attorney or agent for formal filings, oppositions or legal proceedings.

4. Accuracy and completeness

We make every reasonable effort to provide accurate and timely alerts and information. However, trademark publication data in Nepal is subject to delays, omissions and formatting changes by the Department of Industry. We cannot guarantee that every publication will be captured or that information provided by the Department is error-free.

5. Fees and payment

Paid services are billed as agreed in your service engagement. Fees for government filings (application fees, registration fees, renewal fees) are quoted from the Department of Industry's current schedules and may change without notice. Confirm current rates with the Department at filing time.

6. Limitation of liability

To the maximum extent permitted by Nepalese law, IP Watch Nepal shall not be liable for any indirect, incidental, or consequential loss arising from your use of our site or services. Our total liability for any claim related to a monitoring or service engagement shall not exceed the fees you paid for that specific service.

We are not responsible for any loss, cost or damage resulting from a missed publication, delayed alert, or failure to act on an alert, except where caused by our proven negligence.

7. Intellectual property

All content on this site — text, tools, code, design, graphics and trademarks — is the property of IP Watch Nepal or its licensors. You may not reproduce, distribute or create derivative works without our written consent.

8. Links and third parties

This site may contain links to external websites or resources. We are not responsible for the content, accuracy or practices of third-party sites.

9. Governing law

These Terms are governed by the laws of Nepal. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.

10. Changes to these terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
